A random question about screenwriting?

If you are a screenwriter writing scripts for movies and you wanted to write a movie script based on a book or an older movie or video game or board game or the many things that were turned into movies.. does that screenwriter have to get permission first or do they write the script and submit it to the company hoping they would get lucky? It's not like you can patent the script when it's not even your original idea, right?
